An arbitrator hears evidence from the parties to a dispute
and then issues an "award" that explains the specifics
of who gets what. In general, arbitration is cheaper, faster
and more informal than litigation. Unlike litigation, the parties
have much more control in terms of choosing the "judge"
and in determining when and where and how the matter will be
decided. Good arbitrators have experience in conducting hearings,
excellent analytic and reasoning skills, good writing skills
and an ability to quickly learn complex matters.

Mediation is a process in which
a neutral person facilitates communications between disputants
in order to assist them in reaching a mutually acceptable agreement.
This informal process allows people who are involved in a dispute
to resolve their dispute without any legal proceedings. Mediation
can serve as an alternative to a civil lawsuit or arbitration
for businesses and individuals.
Attorney Frank Gritt is certified
by the WV State Bar as a mediator and was appointed to the Alternate
Dispute Resolution Committee. This committee sponsors and conducts
the training and certification for lawyers that wish to practice
Alternate Dispute Resolution. He is scheduled to attend the
Harvard Law School Mediation Program and the Duke University
Private Adjudication Center for mediation training leading to
national certification.

rules, wetland and flood-plain protections. |

Providing personalized service
to individuals and family businesses concerning all aspects
of the accumulation, preservation and transmission of wealth
is an important aspect of law. Lawyers involved in estate planning
and probate assist clients in transferring their assets to family
members in a manner that will minimize income, estate, gift
and generation-skipping transfer taxes and take into account
the special needs of the family members for protection and management
of their assets.
